Don Mariano appeal denied - Tempo



The Land Transportation Franchising and Regulatory Board (LTFRB) denied the appeal of Don Mariano Transit Corp. (DMTC) to continue operating public utility buses following multiple violations of its franchise.


LTFRB chairman Atty. Winston Ginez said DMTC’s motion for reconsideration was denied for utter lack of merit.



In its eight-page resolution dated February 17, 2014, the LTFRB‎ said DMTC’s assertion of exercising “high degree of diligence” in the selection, supervision and maintenance of its drivers was baseless.


“These statements were mere self-serving declarations, unsupported by substantial and convincing evidence that fail to negate the fact that previous infractions and numerous complaints have already occurred and registered on their franchise records,” the resolution reads.


The three-man LTFRB also denied that DMTC ‎was not accorded their rights under due process. (Kris Bayos)
